Conditional Grant Agreements – template and guidance now available

It has been recognised that due to the timing of new procurement in 2009/10 PCTs may find that there is non-recurring element of funding available. Click here to access a template agreement and accompanying guidance which has been developed for use between a PCT and contractor to cover the issue of grants in these circumstances.

The template agreement provides a legal framework under the terms of which PCTs can provide supplementary funding (from either Revenue or Capital Budgets) to NHS dental service providers (“Contractors”) outside existing contractual arrangements for specified capital expenditure which may be required to enhance the quality of NHS service provision.

The intention of the template is to offer a mechanism whereby funding is provided in grant form as an incentive to support the continued provision of NHS dental services under existing GDS or PDS contracts for an agreed term.

It is down to the PCTs to decide upon the appropriate use of this funding, but some examples of some schemes that PCTs have already include funding for decontamination equipment, IT services and infrastructure and NHS signage.

As the template is unbranded, it is also down to PCTs to add their name and NHS logo in the usual format before use.

Clarification of contract variation notices

On 29 May 2009 the Department of Health issued variation notices and templates to update GDS contracts and PDS agreements to reflect changes made to relevant regulations mainly with effect from April 2009. PCC has provided some points of  clarification following comments from PCTs that the notices contain discrepancies.
